When is Consent Required?
Demolition, moving, or altering the exterior of a heritage item or any property in a Heritage Conservation Area requires consent under Tenterfield Local Environmental Plan 2013.
However, maintenance and work of a minor nature can be permitted without a formal application. There are also a number of exempt developments which do not need consent which are covered by the State Environmental Planning Policy (Exempt and Complying Development Codes) 2008.
Maintenance and Minor Works
The applicant must notify Council in writing of the proposed work and Council must provide a written reply before work is commenced advising that it is satisfied that the proposal would not adversely affect the significance of the heritage item or the Heritage Conservation Area.
In this way works that are not covered by exempt developments such as front fences, small alterations, removal of unsympathetic additions, fibro enclosed verandahs, reinstatement of missing details as evidenced by old photos, etc may use this planning clause.
