Information for Businesses: FOGO Exemption Applies in Tenterfield Shire
The NSW Government has mandated the introduction of Food Organics and Garden Organics (FOGO) collection services for households by 2030, with requirements for certain businesses commencing in stages from 1 July 2026.
Council wishes to advise local businesses that they are exempt from the NSW Government's FOGO business requirements from 1 July 2026 until 1 July 2028.
What is the exemption?
Under NSW legislation, businesses that would otherwise be required to collect food organics separately are exempt if they are located in an eligible regional local government area.
Tenterfield Shire qualifies for this exemption because:
- Tenterfield Shire is not located within the Greater Sydney Region; and
- Council does not currently provide a household FOGO or food organics collection service.
Importantly, if Council introduces a household FOGO service during this period, the exemption will continue to apply to local businesses until 1 July 2028.

Businesses are not required to take any action at this time. Council will continue to keep the community informed of any future changes to waste and recycling services, including any updates relating to Food Organics and Garden Organics (FOGO) requirements.
